These general terms and conditions (GTC) apply to all orders placed by customers residing in Switzerland or the Principality of Liechtenstein via the online shop Kafiblitz.shop of Imperial Food Zurich AG, Ackerstrasse 45, 8610 Uster, 0041799451334, info@kafiblitz.shop, Imperial Food Zurich AG (hereinafter referred to as www.KafiBlitz.Shop). www.KafiBlitz.Shop provides all services exclusively on the basis of these general terms and conditions. By placing an order, the customer expressly agrees to these GTC. These form an integral part of the contract between the customer and www.KafiBlitz.Shop.

2. Information on the website/offer/prices

2.1 www.KafiBlitz.Shop always endeavours to provide customers with the best possible information and information about the products and services offered. 2.3 We reserve the right to make changes to prices and product ranges at any time. Images of all products and illustrations are not colour-binding and may differ from the original. 2.5 The prices are binding for both parties at the time of the order. In the event of errors or mistakes in the price information, www.KafiBlitz.Shop reserves the right to make subsequent price changes. In this case, the customer will be informed and is not obliged to purchase the products affected by the price change.

2.6 All prices are in Swiss francs (CHF) and include, unless otherwise stated, statutory VAT.

2.7 In addition to the stated prices, the shipping costs expressly stated on the item page will apply depending on the shipping method (A or B post, collection by customer).

2.8 For orders over 75 CHF, after deduction of discounts and special offers, the shipping costs (excluding A-Post Signature) will be borne by www.KafiBlitz.Shop.

3. Order/Delivery

3.1 An order becomes binding for the customer when he confirms his order at the end of the ordering process on the page on which the overall overview of the order is displayed by clicking the button 'Order with payment'.

3.2 Immediately after placing the order, the customer will receive a corresponding confirmation of receipt from www.KafiBlitz.Shop to the email address provided by the customer. Until an order acceptance is sent to the customer in a separate email, www.KafiBlitz.Shop reserves the right to reject the order or reduce the order quantity, whereby no contract is concluded between the customer and www.KafiBlitz.Shop, or a contract for the reduced order quantity. Unless the customer immediately informs www.KafiBlitz.Shop that he is not interested in the reduced order quantity.

3.3 www.KafiBlitz.Shop reserves the right to reject an order if there is a legal dispute with the customer, in particular in connection with unpaid payments for orders already placed at www.KafiBlitz.Shop, or if other invoices due for payment from the same person or a person living in the same household are still outstanding.

3.4 It is the customer's responsibility to provide a complete and correct delivery address. If the customer provides incorrect delivery addresses, delivery may not be possible and www.KafiBlitz.Shop may refrain from delivering the product altogether without any claims for compensation or damages being made.

3.5 www.KafiBlitz.Shop delivers goods and vouchers exclusively to Switzerland and the Principality of Liechtenstein.

4. Delivery and delivery period

4.1 www.KafiBlitz.Shop has a large stock of products. The shipping policy stipulates that www.KafiBlitz.Shop will ship the products on the day of receipt of payment or confirmation of payment.

5. Products delivered in error

Items delivered in error or in excess must be returned immediately in their original packaging, within 14 days at the latest. All items not returned within this period will be invoiced. The costs for returning the goods sent in error will be borne by www.KafiBlitz.Shop. The return costs will be transferred to the customer in advance.

6. Vouchers

A maximum of one voucher can be redeemed per order. At the end of the ordering process, the voucher code is entered in the field provided. The corresponding amount is deducted directly from the current order. Vouchers that exceed the order amount cannot be refunded.

7. Shipping costs

When completing the order, the customer can choose between shipping by A-Post or B-Post, or self-collection. The shipping costs to be paid by the customer per shipment including VAT are CHF 7.90 for B-Post (PostPac Economy), CHF 8.90 for A-Post

8. Warranty and liability exclusion

8.1 www.KafiBlitz.Shop guarantees that the products are undamaged at the time of shipment. Products that are damaged during shipment will be repaired or replaced at the discretion of www.KafiBlitz.Shop, provided that the customer notifies www.KafiBlitz.Shop of the defect by email within 14 days of receipt of the goods. If www.KafiBlitz.Shop so requests, the customer must also immediately return the delivered products in their original packaging to www.KafiBlitz.Shop; www.KafiBlitz.Shop will cover the shipping costs.

8.2 Furthermore, www.KafiBlitz.Shop is liable to the customer for damages if and to the extent that such liability of www.KafiBlitz.Shop arises from the Product Liability Act.

8.3 Any further warranty for the products delivered and any liability for damage caused by these products is excluded unless www.KafiBlitz.Shop has fraudulently concealed the product defects in question. However, if www.KafiBlitz.Shop can assert further warranty claims against its suppliers for the product in question, www.KafiBlitz.Shop will, as far as possible, assign these claims to the customer at the customer's request. However, www.KafiBlitz.Shop assumes no responsibility for ensuring that these claims can be successfully enforced. The same applies to any claims that www.KafiBlitz.Shop can assert against the post office for damage that occurred during transport.

8.4 In particular, www.KafiBlitz.Shop does not guarantee that the products are suitable for the use intended by the customer or that they will produce a specific result. The guarantee also does not cover damage for which the buyer is responsible, e.g. as a result of improper use of the product, or damage caused by external influences for which the seller is not responsible, such as damage that occurred during transport.

9. Right of withdrawal/right of return

9.1 Customers have the right to return the goods within 14 days after delivery of the goods. The right of return is exercised by returning the goods, no justification is required. The return must be sent to

9.2. Returned products or packages will only be accepted in proper condition, i.e. unused, unopened, undamaged and in their original packaging.

9.3 Exercising the right of return will result in the purchase contract being converted into a reversal relationship, whereby the services received under the purchase contract must be refunded. The customer will bear the costs of returning the goods.

9.4 After receipt of the goods, any purchase price already paid will be refunded to the customer immediately.

10. Means of payment and invoicing/dunning

10.1 Orders placed via the website www.KafiBlitz.Shop must always be paid in advance using the payment methods specified on the website www.KafiBlitz.Shop. The following payment methods are available: PayPal, credit card (Visa, Mastercard, American Express), Maestro, PostCard, PostFinance Direct, prepayment, invoice (after successful credit check), Twint. If delivery against invoice is specified as an option when ordering, the payment period per shipment is 20 days.

10.2 Purchase on account with partial payment option (POWERPAY). MF Group / POWERPAY offers the payment method “purchase on account” as an external payment service provider. With the individual invoice, you can easily pay for your online purchase by invoice. If you do not pay within the specified time frame, you will subsequently receive a monthly invoice with an order overview in the following month.

10.4 A credit check can be carried out at any time for both new and existing customers.

10.5 Until full payment of the ordered products or confirmation of payment by the credit card provider, the delivered products remain the property of www.KafiBlitz.Shop.

11. Data protection

11.1 If www.KafiBlitz.Shop makes advance payments, e.g. when purchasing on account, www.KafiBlitz.Shop may obtain a credit report from a credit agency based on mathematical-statistical procedures in order to protect its legitimate interests. www.KafiBlitz.Shop points out that payment histories, in particular regarding undisputed claims and claims that have not been paid after they have become due, as well as debt collection information and address data, if applicable, are transmitted to PowerPay in Zurich for lawful use as a credit agency. POWERPAY will use the data to check your identity and creditworthiness and will disclose it to authorized third parties. The payment histories can be analyzed by POWERPAY on the basis of mathematical-statistical calculation methods for automated decision-making, in particular for assessing a person's creditworthiness.

11.3 Under “My Account” the customer has the possibility to change his personal data at any time.

11.5 The customer will only receive a newsletter from www.KafiBlitz.Shop if he or she expressly requests it. The customer can unsubscribe at any time.

12. Liability

12.1 Liability for product defects or damage caused by such defects is governed exclusively by Section 8. For damages resulting from late delivery, Section 4 shall apply exclusively.

12.2 Furthermore, www.KafiBlitz.Shop excludes, to the extent permitted by law, any other liability to the customer for damages arising in connection with the products, the use or the (non-)availability of the website www.KafiBlitz.Shop. For example, claims for damages arising from impossibility of performance, non-fulfillment and tortious acts against www.KafiBlitz.Shop and its vicarious agents are excluded, unless there is intentional or grossly negligent action.

13. Partial invalidity/validity-preserving reduction

If any provision of these Terms and Conditions is invalid in whole or in part, this will not affect the validity of the remaining provisions and their purpose. The relevant statutory provisions will apply in place of the invalid provisions.

14. Applicable law/place of jurisdiction

The contract is subject exclusively to Swiss law. The place of jurisdiction for all disputes with www.KafiBlitz.Shop is - subject to different mandatory places of jurisdiction under federal law - Zurich, Switzerland.

15. Changes to Terms and Conditions

www.KafiBlitz.Shop reserves the express right to adapt these general terms and conditions to the circumstances at any time and to apply them immediately to orders placed thereafter.
